Question:
Do the religious activities (example: vows, divorces, oaths, etc.), which require verbal utterance of a person, come into effect by mere movement of tongue without using the lips? Even if one uses the lips along with the tongue, but does not make an audible word, would his utterance come into effect?
Answer:
بِسْمِ اللهِ الرَّحْمنِ الرَّحِيْم
In the name of Allāh, Most Gracious, Most Merciful.
Jazāk Allāh Khayr/ Thank you for contacting Mathabah.
Islamicaly, verbal utterances for vows, divorce and oaths etc. come into effect when there is an intention along with at least tongue movement or documented clear communication (such as writing or typing). The voice does not need to be heard. – (See: Al-Bazāzīyah, Vol 1, Page 95, Dār Al-Kutub Al-‘Ilmīyyah)[1]
