Question:
What is the status of a marriage wherein a husband said to his wife, “I give you a million ṭalāqs (divorces).”?
Answer:
In the Name of Allāh, the Almighty, the Most Merciful, the Most Kind.
When a husband utters the words, “I have given you one million divorces” to his wife, the ruling is that it establishes three divorce pronouncements. Thus, the marriage has concluded and there is no possibility for the couple to reconcile. This is the view of the four mainstream schools of jurisprudence, Ḥanafī, Shāfi’īe, Mālikī and Ḥanbalī, as well as the jamhūr (majority muslim jurists). – (See: Al-Fiqh ‘Alā Madhāhib Al-‘Arba’ah, Vol. 4, Page 303, Dār Al-Kutub Al-‘Ilmīyyah[1], Mukhtaṣar Al-Qudūrī Page 159, Dār Al-Kutub Al-‘Ilmīyyah[2])
“And if he has divorced her [for the third time], then she is not lawful to him afterward until [after] she marries a husband other than him. And if the latter husband divorces her [or dies] there is no blame upon the woman and her former husband for returning to each other if they think that they can keep [within] the limits of Allāh. These are the limits of Allāh, which He makes clear to a people who know.” – (Qur’ān 2:230)[3]
Ibn ‘Abbās (may Allāh be pleased with him) ruled three divorces for the husband who gave his wife 100 and in another case 1000 divorce pronouncements in a single statement. – (See: Muṣannaf Ibn Abī Shaybah 18752[4] and 18753[5])
